Electronic Consent Agreement

1. Purpose of This Agreement
This Electronic Consent Agreement ("Agreement") governs your consent to conduct business electronically with The 36th Solutions Ltd ("we", "us", or "our"). By using the Odogwu application, you agree to receive disclosures, notices, agreements, and communications electronically.
2. Scope of Electronic Communications
You consent to receive the following electronically: • Account opening and verification documents • Transaction receipts and confirmations • Account statements and balance notifications • Fee disclosures and changes • Privacy policy and terms of use updates • Regulatory notices and disclosures • Customer support communications • Marketing communications (where you have opted in)
3. Electronic Signature Consent
By tapping "Agree", "Confirm", "Submit", or similar buttons within the Odogwu App, you are providing your electronic signature. Your electronic signature has the same legal effect as a handwritten signature under the Nigerian Electronic Transactions Act and applicable laws. You acknowledge that: • Electronic signatures are legally binding • You intend to sign electronically • You have the authority to enter into binding agreements
4. Hardware and Software Requirements
To access and retain electronic communications, you need: • A smartphone running Android 6.0 or iOS 13 or later • The Odogwu application (latest version recommended) • A valid email address for email communications • A valid phone number for SMS notifications • Internet connectivity • Sufficient storage to save documents
5. Withdrawing Consent
You may withdraw your consent to electronic communications at any time by contacting us at support@odogwu.app. Please note that withdrawing consent may limit or prevent your ability to use certain features of the App, as electronic communication is integral to our service delivery. Withdrawal of consent does not affect the validity of any electronic communications or signatures made prior to withdrawal.
6. Updating Your Contact Information
You are responsible for keeping your contact information (phone number and email address) current in the App. The 36th Solutions Ltd is not responsible for failed delivery of electronic communications due to outdated contact information. To update your information, go to Profile Settings within the App.
7. Paper Copies
You have the right to request a paper copy of any electronic communication. To request paper copies, contact us at support@odogwu.app. We may charge a reasonable fee for paper copies. Paper copies will be delivered to your registered address within 14 business days.
8. Record Retention
We recommend that you print or save copies of all electronic communications for your records. You can access your transaction history and account documents within the App at any time. The 36th Solutions Ltd retains electronic records in accordance with Nigerian financial regulations.
9. Security of Electronic Communications
We use industry-standard encryption and security protocols to protect electronic communications. However, you acknowledge that no electronic transmission is completely secure. You agree to: • Keep your login credentials confidential • Log out of the App when not in use • Notify us immediately of any suspected unauthorized access • Use the App only on trusted devices
10. Regulatory Compliance
This Agreement is made in compliance with: • The Nigerian Electronic Transactions Act • Central Bank of Nigeria (CBN) guidelines on electronic banking • Nigeria Data Protection Regulation (NDPR) • Financial Action Task Force (FATF) recommendations on digital financial services
11. Amendments
The 36th Solutions Ltd reserves the right to amend this Agreement at any time. We will notify you of material changes through the App or by electronic communication. Your continued use of the App after notification constitutes acceptance of the amended Agreement.
