1. Acceptance of Terms
By downloading, installing, or using the Odogwu application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and The 36th Solutions Ltd ("we", "us", or "our").
2. Eligibility
You must be at least 18 years of age and a resident of Nigeria to use Odogwu. By using the App, you represent and warrant that you meet these eligibility requirements. We reserve the right to refuse service to anyone for any reason at any time.
3. Description of Service
Odogwu is a digital money-spraying platform that allows users to send and receive money digitally at events and celebrations. The App facilitates peer-to-peer transfers, wallet top-ups, and withdrawals. Odogwu is not a bank and does not hold banking licenses. Financial services are provided in partnership with licensed financial institutions.
4. Account Registration
To use Odogwu, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Fees and Charges
Odogwu charges a 1% transaction fee on every spray (capped at ₦500), a flat ₦50 fee on withdrawals, and no fee on top-ups. Fees are subject to change with prior notice. By using the App, you consent to the deduction of applicable fees from your transactions.
6. Prohibited Activities
You agree not to use the App for any unlawful purpose, including but not limited to: money laundering, fraud, financing of terrorism, or any activity that violates applicable Nigerian laws and regulations. You may not use the App to send or receive funds on behalf of third parties without proper authorization.
7. Wallet and Funds
Your Odogwu wallet holds funds on your behalf. Wallet balances are not insured by the Nigerian Deposit Insurance Corporation (NDIC). We are not liable for losses resulting from unauthorized access to your account due to your failure to maintain account security. Withdrawals are subject to verification and may be delayed for security purposes.
8. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of The 36th Solutions Ltd and are protected by Nigerian and international intellectual property laws.
9. Limitation of Liability
To the maximum extent permitted by law, Odogwu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim arising from these Terms shall not exceed the amount of fees paid by you in the three months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease. Any funds in your wallet at the time of termination will be returned to you subject to verification.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
